Ethics and Human Rights in a Globalized World

By:Klaus Hoffmann-Holland
Published on 2009 by Mohr Siebeck
ISBN 9783161499920

Synopsis
In a globalized world, an interdisciplinary dialogue on ethics and human rights is possible, necessary and fruitful for jurisprudence. Human rights can be understood as formalized ethics, and ethics can thus serve as a foundation for human rights. They are the framework for a communication of rights, and this communication is the context in which wrongs can be transformed into rights. Ethics do however also shape existing (recognized) human rights. Human rights are ethics in action. The enforcement of human rights, especially in international criminal law, as well as the implementation structures bring the ideas and principles of rights to life in a globalized world. Thus it is advisable to take an interdisciplinary approach to participation rights, social rights and human rights in general, in private and in public life. This work contains articles that were presented at an international and interdisciplinary conference on Ethics and Human Rights in a Globalized World in Jerusalem in the fall of 2008. Young researchers from Israel and Germany, who work in the fields of law, philosophy, political science and theology, deal with the foundation of human rights, the conflict between varying human rights and effective implementation structures. The part played by the World Bank in implementing human rights is highlighted, as is the significance of local cultural backgrounds. Other articles deal with the correlation of international criminal law and human rights. The book also contains an article by Aharon Barak, former Chief Justice of the Israel Supreme Court.

By:Mary Midgley
Published on 2004-03-01 by Routledge
ISBN 9781134438440

Synopsis
Philosophers have traditionally concentrated on the qualities that make human beings different from other species. In Beast and Man Mary Midgley, one of our foremost intellectuals, stresses continuities. What makes people tick? Largely, she asserts, the same things as animals. She tells us humans are rather more like other animals than we previously allowed ourselves to believe, and reminds us just how primitive we are in comparison to the sophistication of many animals. A veritable classic for our age, Beast and Man has helped change the way we think about ourselves and the world in which we live.

Better than Human

By:Allen Buchanan
Published on 2011-07-01 by Oxford University Press
ISBN 9780199797998

Synopsis
Is it right to use biomedical technologies to make us better than well or even perhaps better than human? Should we view our biology as fixed or should we try to improve on it? College students are already taking cognitive enhancement drugs. The U.S. army is already working to develop drugs and technologies to produce |super soldiers.| Scientists already know how to use genetic engineering techniques to enhance the strength and memories of mice and the application of such technologies to humans is on the horizon. In Better Than Human, philosopher-bioethicist Allen Buchanan grapples with the ethical dilemmas of the biomedical enhancement revolution. Biomedical enhancements can make us smarter, have better memories, be stronger, quicker, have more stamina, live much longer, avoid the frailties of aging, and enjoy richer emotional lives. In spite of the benefits that biomedical enhancements may bring, many people instinctively reject them. Some worry that we will lose something important-our appreciation for what we have or what makes human beings distinctively valuable. Others assume that biomedical enhancements will only be available to the rich, with the result that social inequalities will worsen. Buchanan shows that the debate over enhancement has been distorted by false assumptions and misleading rhetoric. To think clearly about enhancement, we have to acknowledge that human nature is a mixed bag and that our species has many |design flaws.| We should be open be open to the possibility of becoming better than human, while never underestimating the risks that our attempts to improve may back-fire.

By:Cindy Holder,David Reidy
Published on 2013-05-23 by Cambridge University Press
ISBN 9781107067141

Synopsis
The United Nations General Assembly adopted the Universal Declaration of Human Rights in 1948. A burgeoning human rights movement followed, yielding many treaties and new international institutions and shaping the constitutions and laws of many states. Yet human rights continue to be contested politically and legally and there is substantial philosophical and theoretical debate over their foundations and implications. In this volume, distinguished philosophers, political scientists, international lawyers, environmentalists and anthropologists discuss some of the most difficult questions of human rights theory and practice: what do human rights require of the global economy? Does it make sense to secure them by force? What do they require in jus post bello contexts of transitional justice? Is global climate change a human rights issue? Is there a human right to democracy? Does the human rights movement constitute moral progress? For students of political philosophy, human rights, peace studies and international relations.

Human Rights as Politics and Idolatry:

Download Human Rights as Politics and Idolatry: PDF/eBook

By:Michael Ignatieff,Amy Gutmann
Published on 2003-02-16 by Princeton University Press
ISBN 9780691114743

Synopsis
Michael Ignatieff draws on his extensive experience as a writer and commentator on world affairs to present a penetrating account of the successes, failures, and prospects of the human rights revolution. Since the United Nations adopted the Universal Declaration of Human Rights in 1948, this revolution has brought the world moral progress and broken the nation-state's monopoly on the conduct of international affairs. But it has also faced challenges. Ignatieff argues that human rights activists have rightly drawn criticism from Asia, the Islamic world, and within the West itself for being overambitious and unwilling to accept limits. It is now time, he writes, for activists to embrace a more modest agenda and to reestablish the balance between the rights of states and the rights of citizens. Ignatieff begins by examining the politics of human rights, assessing when it is appropriate to use the fact of human rights abuse to justify intervention in other countries. He then explores the ideas that underpin human rights, warning that human rights must not become an idolatry. In the spirit of Isaiah Berlin, he argues that human rights can command universal assent only if they are designed to protect and enhance the capacity of individuals to lead the lives they wish. By embracing this approach and recognizing that state sovereignty is the best guarantee against chaos, Ignatieff concludes, Western nations will have a better chance of extending the real progress of the past fifty years. Throughout, Ignatieff balances idealism with a sure sense of practical reality earned from his years of travel in zones of war and political turmoil around the globe. Based on the Tanner Lectures that Ignatieff delivered at Princeton University's Center for Human Values in 2000, the book includes two chapters by Ignatieff, an introduction by Amy Gutmann, comments by four leading scholars--K. Anthony Appiah, David A. Hollinger, Thomas W. Laqueur, and Diane F. Orentlicher--and a response by Ignatieff.

By:Erich Fromm
Published on 1997-03-01 by A&C Black
ISBN 9780826410054

Synopsis
Any attempt to identify the thread that runs through the late Erich Fromm's writings will soon uncover an unequivocally humanistic world view. From the 1930s on, this was Fromm's guiding principle. It signified Fromm's break with the Frankfurt School: Marcuse, Adorno and Horkheimer. This posthumous volume includes writings from one of Fromm's most fertile periods--the 1960s. These writings concentrate on humanistic science, socialism, religion, and psychoanalysis. They are from lectures, works written for specific occasions, and manuscripts intended as books. Of particular interest is an extended essay on two very different thinkers: Meister Eckhart and Karl Marx.

On Human Rights

Download On Human Rights PDF/eBook

By:James Griffin
Published on 2008-02-14 by OUP Oxford
ISBN 9780191553509

Synopsis
What is a human right? How can we tell whether a proposed human right really is one? How do we establish the content of particular human rights, and how do we resolve conflicts between them? These are pressing questions for philosophers, political theorists, jurisprudents, international lawyers, and activists. James Griffin offers answers in his compelling new investigation of the foundations of human rights. First, On Human Rights traces the idea of a natural right from its origin in the late Middle Ages, when the rights were seen as deriving from natural laws, through the seventeenth and eighteenth centuries, when the original theological background was progressively dropped and 'natural law' emptied of most of its original meaning. By the end of the Enlightenment, the term 'human rights' (droits de l'homme) appeared, marking the purge of the theological background. But the Enlightenment, in putting nothing in its place, left us with an unsatisfactory, incomplete idea of a human right. Griffin shows how the language of human rights has become debased. There are scarcely any accepted criteria, either in the academic or the public sphere, for correct use of the term. He takes on the task of showing the way towards a determinate concept of human rights, based on their relation to the human status that we all share. He works from certain paradigm cases, such as freedom of expression and freedom of worship, to more disputed cases such as welfare rights - for instance the idea of a human right to health. His goal is a substantive account of human rights - an account with enough content to tell us whether proposed rights really are rights. Griffin emphasizes the practical as well as theoretical urgency of this goal: as the United Nations recognized in 1948 with its Universal Declaration, the idea of human rights has considerable power to improve the lot of humanity around the world. We can't do without the idea of human rights, and we need to get clear about it. It is our job now - the job of this book - to influence and develop the unsettled discourse of human rights so as to complete the incomplete idea.

By:Jeffrey H. Reiman
Published on 1999 by Rowman & Littlefield
ISBN 9780847692088

Synopsis
In this text, Jeffrey Reiman argues that an overlooked clue to the solution of the moral problem lies in the unusual way in which we value the lives of individual human beings - namely, that we value them irreplaceably. We think it is not only wrong to kill an innocent human child or adult, but that it would not be made right by replacing the dead one with another living one, or even several.

By:Robert Sokolowski
Published on 2008-05-12 by Cambridge University Press
ISBN 9781139472999

Synopsis
In this book, Robert Sokolowski argues that being a person means to be involved with truth. He shows that human reason is established by syntactic composition in language, pictures, and actions and that we understand things when they are presented to us through syntax. Sokolowski highlights the role of the spoken word in human reason and examines the bodily and neurological basis for human experience. Drawing on Husserl and Aristotle, as well as Aquinas and Henry James, Sokolowski here employs phenomenology in a highly original way in order to clarify what we are as human agents.
